Have you been authorized by Rick Retvield to use his Einstein

This morning I have discovered into a flea market in Milan that were sold some shirts with a design that seem taken from an iconic image of the surfwear artist Rick Retveild ( art director before of the brand Maui and Sons) representing Albert Einstein in his summer vacations at Hawai islands . Was it done with the consent of the author of the image ( there 's not Retveild signature)? He is aware of its ' changes'?
